This Privacy Notice for Sightseeker LLC (“Company,” “we,” “us,” or “our”) describes how we might collect, store, use, and/or share (“process”) your information when you:

By using our Services, you consent to the collection and use of information in accordance with this Privacy Policy. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms of Use, accessible at Sightseekertours.com/terms.​
PROVIDED PERSONAL INFORMATION

We collect “Personal Information” that you voluntarily provide to us when you register for our Services, express an interest in obtaining information about us or our products and Services, when you participate in our “quests” (activities on the Services), or otherwise when you contact us. We collect this information for the purpose of providing our Services, communicating with you, responding to your requests/inquiries, improving our Services, troubleshooting and for our internal analytics and reporting purposes.

Personal Information: includes, but is not limited to, your name, email address, passwords, and payment data (data necessary to process your payment if you make a purchase). All payment data is stored by Stripe (go to TK to see its privacy notice).

Application Data: If you use our app, we may collect the following if you choose to provide us with access or permission:

Geolocation Information: we may request access or permission to track location-based information from your mobile device, either continuously or while you are using our app, to provide certain location-based services. If you wish to change our access or permissions, you may do so in your device’s settings.

Mobile Device Access. We may request access or permission to certain features from your mobile device, including your device’s camera, Bluetooth, and other features. If you wish to change our access or permissions, you may do so in your device’s settings.

Outreach and Promotion. We see our users as members of a common club or as we put it, a “community of curiosity, sharing the same interest in stories and places. A club requires internal communication and, if you grant permission, we will reach out to you with information that we think will be of interest (new quests, did you knows, Sightseeker events, etc.) through email, social media, and other communication vehicles. If you decide at any time that you no longer wish to receive such communications, just follow the unsubscribe instructions provided in the communications.
INFORMATION AUTOMATICALLY COLLECTED

In addition to the Personal Information that you provide we also collect certain information when you visit, use, or navigate our Services. This information does not reveal your specific identity (like your name or contact information) but may include device, log, and usage data (see below). This information is used primarily to maintain the security and operation of our Services, and for internal and reporting purposes
Like many internet-based businesses we also collect information through cookies and similar technologies.

Device, Log and Usage Data: this data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access our Services and which we record in log files. Depending on how you interact with us this data might include your IP address, browser and device characteristics, information about your activity in the Services (such as date/time stamps, pages and files viewed, searches, which features you use, and other actions), operating system, language preferences, referring URLs, country, location, and other technical information.
HOW WE USE THIS INFORMATION?

To make the app better: to monitor and analyze use of the Services, for the Services’ technical administration, to increase our Services’ functionality and user-friendliness, and to better tailor it to your needs.
For outreach: as explained above, we use the information (with permission) to communicate with our “community of curiosity,” those users who wish to be kept informed about additions and improvements to the app, and other related communications (email, social media, etc.).
WHEN DO WE SHARE THIS INFORMATION?

Partners: Sightseeker would not be possible without the support of industry partners such as tourist boards, sight administrators, museums, etc. To operate these partnerships we may share non-personal information, statistics and the aggregated anonymous information on which the statistics. These statistics and information contain no Personal Information.

Business transfers: we may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, acquisition of all or a portion of our business to another company, or in the case of bankruptcy.

Map platform APIs: we may share your information with certain map platforms including but not limited to Google Maps and Apple Maps.

Law enforcement: we may disclose your information if we believe that it is reasonably necessary to comply with a law, regulation, or legal request; to protect the safety of any person; to address fraud, security, or technical issues; or to protect Sightseeker’s rights or property.
COOKIES AND OTHER TRACKING TECHNOLOGIES

We may use cookies or similar tracking technologies (like web beacons and pixels) to collect and store your information. Specific information about how we use such technologies and how you can refuse certain cookies is set out in our Cookie Notice.

Most web browsers are set up to accept cookies by default. If you prefer, you can choose to remove cookies or reject cookies. If you chose one of these options it could affect certain features or services.

LOCATION INFORMATION

With your permission, we may also collect your GPS or other location information. This information is helpful because it enables us to provide location-specific services to you when you use the app, such as telling you about important sites that are near you, or offering content or offers to you. If you choose not to allow us to collect your location information, you will not be able to access the location features of the app.
DEVICE INFORMATION

We may collect information about your mobile device and internet connection, including the device’s unique identifier, operating system, browser type, mobile network information and the device’s telephone number.
IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?

Our servers are located in the U.S. If you are accessing our Services from outside the U.S., be aware that your information may be transferred to, store, and processed by us and by those third parties with whom we may share your Personal Information in the U.S. and other countries.

Your information may be transferred to and maintained on computers located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. Your consent to this Privacy Policy by accessing or using the Services followed by your submission of such information represents your agreement to that transfer.

Currently Sightseeker only offers the Services in the U.S. To the extent that GDPR or successor laws apply, Sightseeker will be the controller of your Personal Information processed in connection with the Services.
SOCIAL NETWORK CONNECTIONS

When using our Services you may opt to link your accounts with third party social networking services (“SNSs”) and, in doing so, may associate Personal Information from that SNS with your account on the Services. If you choose to link your account with an SNS then, with your permission and on your behalf, we will share your Personal Information, including, but not limited to, information contained in your profile and any Content with the applicable SNS.

Through use of such SNS’s APIs we also receive certain information (which may include your Personal Information) in accordance with the privacy settings you have set in your SNS account, if any. Other than what we may share with the SNS in connection with your linking of accounts, the personal information an SNS has about you is obtained by the SNS independent of our Services. Other services follow different rules regarding the use or disclosure of the personal information you submit to them. We encourage you to read the privacy policies or statements of the other services you use.
If you link an SNS account to your Sightseeker account on the Services then, depending on the settings you have selected on the SNS, users of that SNS may be able to search for and find your linked account on the Services and/or use that SNS to view your activity on the Services. We will not post any information to an SNS on your behalf without first obtaining your consent.
THIRD PARTY WEB SITES

Our Services may contain links to other web sites. The fact that we link to a web site is not an endorsement, authorization, or representation of our affiliation with that third party, nor is it an endorsement of their privacy or information security policies or practices.

We do not exercise control over third party web sites or over the choice of which third party sites are linked to using the Services. These other web sites may place their own cookies or other files on your phone or computer, collect data, or solicit personal information from you. Other sites follow different rules regarding the use or disclosure of the personal information you submit to them. SERVICE PROVIDERS

We may employ third party companies and individuals to facilitate our Services, to provide the Services on our behalf, to perform site-related services (e.g., without limitation, maintenance services, database management, web analytics and improvement of the Services’ features) or to assist us in analyzing how our Services are used.
These third parties have access to your Personal Information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of Personal Information (if any) that we disclose to third parties for direct marketing purposes and the names and addresses of all third parties with which we have shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit it through info@sightseekertours.com.

If you are under 18 years of age, reside in California, and have a registered account with Services, you have the right to request removal of unwanted data that you publicly post on the Services. To request removal of such data, please contact is at info@sightseekertours.com and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on Services, but please be aware that the data may not be completely or comprehensively removed from all our systems (e.g., backups, etc.).

HOW LONG DO WE KEEP YOUR INFORMATION?

We will only keep your Personal Information for as long as it’s necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).
When we have no ongoing legitimate need to hold your Personal Information, we will either delete or anonymize this information, or, if this is not possible (for example, if your information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.
HOW DO WE KEEP YOUR INFORMATION SAFE?

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any information we process. However, despite such safeguards and efforts to secure your Personal Information, no electronic transmission over the Internet or information storage technology can be guaranteed 100 percent secure, so we cannot promise that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly access, steal, or modify you information.

Although we will do our best to protect your Personal Information, transmission of personal information to and from our Services is entirely at your own risk. You should only access our Services within a secure environment.

WITHDRAWING YOUR CONSENT

If we are relying on your consent to process your Personal Information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can do this by contacting us at info@sightseekertours.com.
However, this will not affect the lawfulness of the processing before its withdrawal, nor when applicable law allows, will it affect the processing of your Personal Information conducted in reliance on lawful processing grounds other than consent.
OPTING IN/OUT OF MARKETING, PROMOTIONAL AND OTHER COMMUNICATIONS

You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we end, or by contacting us at info@sightseekertours.com. You will then be removed from our marketing lists. However, we may still communicate with you – for example, to send you service-related messages that are necessary for the administration and use of your account, to responds to service requests, or for other non-marketing purposes.
ACCOUNT INFORMATION

You can review or change the information in your account or terminate your account by contacting us at info@sightseekertours.com.

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements.
CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have any data about your online browsing activities monitored and collected. At this point in time no uniform standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.

If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.
UPDATING THIS NOTICE

We may update this privacy notice at any time. The updated version will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible. If we make material changes to this privacy notice, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification.
